PROMOTION OF ACCESS TO INFORMATION ACT (PAIA) MANUAL

(Prepared in terms of Section 51 of the Promotion of Access to Information Act 2 of 2000)

  1. Introduction

This Manual is prepared in accordance with section 51 of the Promotion of Access to Information Act, 2000 (“PAIA”).

PAIA gives effect to the constitutional right of access to information held by public and private bodies that is required for the exercise or protection of any rights.

This manual assists persons wishing to request access to records held by the Company.

  1. Request Procedure for Access to Records

A request for access to records must be made using Form 2 (PAIA Request Form).

The request must include:

  • The requester’s details
  • Description of the requested record
  • The right the requester seeks to exercise or protect
  • The form of access required

Requests must be submitted to the Information Officer.

  1. Prescribed Fees

The prescribed fees are determined by PAIA regulations.

These may include:

  • Request fee
  • Access fee (depending on the type and volume of records requested)

The requester will be notified of any applicable fees before processing the request.

  1. Grounds for Refusal of Access

Access to records may be refused in accordance with PAIA where disclosure may involve:

  • Protection of personal information of third parties
  • Protection of confidential commercial information
  • Protection of safety or security of individuals
  • Protection of legally privileged information
  • Protection of company trade secrets
  1. Remedies Available

If a requester is dissatisfied with a decision regarding a PAIA request, the requester may:

  • Lodge a complaint with the Information Regulator, or
  • Apply to a court of competent jurisdiction for relief.
